各位朋友大家好，這是我們避碰規則第三條的講解，這條是名稱的定義。好現在我們來看看，vessel包括那個種在水面上的船隻，與非排水量的船隻，或者是seaplane水上飛機，起飛或降落的階段，必須在水面加速減速的飛機。power driven vessel動力船隻，就是使用機械動力推進的船隻。Sailing vessel 帆船，任何的船隻使用帆布駛風，即使是他船上有這個機械，但是呢沒有使用機器推進，也算是帆船。vessel engaged in fishing從事捕魚的工作,漁船的意思是使用漁網NET，延繩釣line ，一條主繩旁邊接了一些副繩，拖網，其他的漁具，使運轉率力受限制，才能稱為漁船。一條船可能只有很少數的釣線在水裡面釣魚，其運轉力不受限制，就不能稱為漁船，實際上，在日本多的是釣魚船，如果你不讓他的路，就等著吃官司。

seaplane水上飛機包括的任何的飛機，設計的可以在水面運轉的，就叫做水上飛機。當然有的水上飛機呢，他起飛降落一定要在水面上，他在水面的這段過程，就算是船隻的一種。現在新的避碰規則呢，多的就是WIG wing in ground aircraft 地面效應飛機,這種飛機呢,只能在海面20公尺高度內飛行，算是船隻的一種，適用於避碰規則。

vessel not under command操縱失靈的船隻，就是因為某些例外的情況，船隻真的沒有辦法，依照避碰規則來運轉，停車的時候沒辦法停車，該轉向的時候沒有辦法轉向，所以呢沒有辦法呢對其他的船隻讓路，所以他就是操縱失靈的船隻，主要講的是讓路船，如果你是直航船的話，那就無所謂你能不能夠操縱，你就是保持原來的航向航速。

船隻呢運轉力受限制，表示船隻呢因為他工作的關係，然後限制他的能力去轉向或是停車。這個當然那也是針對讓路船來講，所以呢沒有辦法對其他的船隻讓路，運轉力受限制的船隻呢，應該包括下列船隻，但是呢不只，還有其他的更多的船隻，也是運轉力受限制的船隻。

沒辦法對其他的船隻讓路，第一是從事安放，維修或收回導航標誌，海底電纜，水下管路的船隻。第二是船隻從事挖掘，測量或水下作業的船隻。第三是船隻在航行中從事補給，轉移人員，口糧或貨物。第四是呢發射或者是收回飛機的時候，這就是表示航空母艦啊，當然啊這個有會飛的東西，不一定是航空母艦，有的時候，是呢直升機，有錢人的超級。第五是從事掃雷作業的船隻，當然他這個隨便亂開，就會碰到水雷，這時候呢他就是運轉力受限制。第陸船隻呢從事拖船，運轉的能力受限制，或者呢這個不是拖船，可能是被拖的油駁，barge被拖呢，沒有能力來deviate，就是離開他們原來的航向，就是不管是拖船或者是被拖的東西，那都可能呢沒有辦法，依照規則的要求呢來轉向或是停車。那這6種船是運轉力受限制的船隻，那當然其他呢有特殊情形在規則裡面，沒有規定的，也可以使用這一個規定，只要呢出事的時候，他在法庭上面的站得住腳，就好了。另外一種船隻呢叫做吃水受限制的船隻，吃水所限制的船隻，那這個是一個power-driven vessel, 這邊呢特別講到，這是什麼？這是動力船隻，因為他的吃水呢跟使用的水深，限制到他的能力去離開他的原來的航向。下面一個underway航行中，船隻是哪有3個情景，算是航行中，沒有下錨，綁在岸邊，或者是沒有擱淺。反正浮在水面上，跟地球呢沒有任何的聯繫，那就算是在航行中。哪下錨就是用錨呢跟地球連結，綁在碼頭邊就是用纜繩，擱淺就是用船身直接跟地球接觸，所以只要漂在水面上的東西呢，都叫做航行中，要怎麼樣？遵守避碰規則的規定。

在避碰規則使用的長度，表示他的全長，包括他船上的突出水面的部位，都算他長度的一部分，跟他最大的寬度。

船隻相互看見，應該是in sight of one another,相互看見只有在什麼時候，可以用眼睛看到另外一條船的時候。所以這是在能見度良好的時候，眼睛可以看到另外一條船，那能見度不好的時候呢，陸海裡看不到，要到三海浬的距離才看得到，因為中間隔了一層薄薄的霧，或者是因為下雨，或者是雷陣雨，或是沙塵暴等等，假如眼睛看不到，這個就算是什麼在霧中，這裡的規定說呢，兩條船相互看見，實際上呢是在規定呢，眼睛看不到就算是在霧區，要使用下面的第19條，能見度受限制時的避碰措施。

restricted visibility能見度受限制，代表在任何情況能見度受到限制，霧，霾就是比較小的水珠，現在流行的PM2.5造成的,降雪或者是沙塵暴等等。

最後一個呢mile, 這裡避碰規則表示能見度的距離，使用的是海浬，不是陸地上的公浬，我們舊的第三條呢的規則，是到這裡。新的規則是最後面多了一個w i g地面效應飛機的定義，前面我們說過了。

RULE 3 - General definitions

For the purpose of these Rules, except where the context otherwise requires -

the word "vessel" includes every description of water craft, including non-displacement craft and seaplanes, used or capable of being used as a means of transportation on water;

the term "power-driven vessel" means any vessel propelled by machinery;

the term " sailing vessel" means any vessel under sail provided that propelling machinery, fitted, is not being used;

the term "vessel engaged in fishing" means any vessel fishing with nets, lines, trawls or other fishing apparatus which restrict maneuverability, but does not include a vessel fishing with trolling lines or other fishing apparatus which do not restrict maneuverability;

the word "seaplane" includes any aircraft designed to manoeuvre on the water;

the term "vessel not under command" means a vessel which through some exceptional circumstances is unable to manoeuvre as required by these Rules and is therefore unable to keep out of the way of another vessel;

the term "vessel restricted in her ability to manoeuvre" means a vessel which from the nature of her work is restricted in her ability to manoeuvre as required by these Rules and is therefore unable to keep out of the way of another vessel. The term "vessels restricted in their ability to manoeuvre" shall include but not be limited to:

a vessel engaged in laying, servicing or picking up a navigation mark, submarine cable or pipeline;

a vessel engaged in dredging, surveying or underwater operations;

a vessel engaged in replenishment or transferring persons, provisions or cargo while underway;

a vessel engaged in the launching or recovery of aircraft;

a vessel engaged in minesweeping operations;

a vessel engaged in a towing operation such as severely restricts the towing vessel and her tow in their ability to deviate from their course;

the term "vessel constrained by her draught" means a power-driven vessel which because of her draught in relation to the available depth of water is severely restricted in her ability to deviate from the course she is following;

the word "underway" means that a vessel is not at anchor, or made fast to the shore, or aground;

the words "length" and "breadth" of a vessel mean her length overall and greatest breadth;

vessels shall be deemed to be in sight of one another only when ore can be observed visually from the other;

the term "restricted visibility" means any condition in which visibility is restricted by fog, mist, falling snow, heavy rainstorms, sandstorms or any other similar causes.
